1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Pool Bros Marketing website and services provided by Rocket Digital Marketing LLC ("Company," "we," "us," or "our"), operating as Pool Bros Marketing. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Services

Pool Bros Marketing provides full-service digital marketing and AI-powered services exclusively for pool contractors, including but not limited to:

• Website design and development
• Search engine optimization (SEO)
• Pay-per-click (PPC) advertising management
• Social media management
• Email marketing
• Review management
• AI chatbot deployment and management
• AI lead qualification
• Graphic design and video editing
• Content marketing

The specific services provided to each client are governed by a separately executed service agreement or statement of work.

3. Service Agreement and Billing

Engagement of Pool Bros Marketing services is governed by the following terms:

• Initial Term: All service agreements require a minimum 6-month initial term, beginning on the date services commence.
• Monthly Fee: The standard all-inclusive package is billed at $2,500 per month, payable in advance on the first of each month.
• Ad Spend: Advertising spend (Google Ads, Meta Ads, etc.) is separate from our management fee and is paid directly by the client to the respective advertising platforms.
• After Initial Term: Following the 6-month initial term, the agreement converts to month-to-month with 30 days written notice required to terminate.
• Late Payments: Accounts past due by more than 10 days may result in suspension of services.

4. Client Responsibilities

To enable us to deliver effective marketing services, clients agree to:

• Provide timely access to necessary accounts, assets, and information required for onboarding and campaign setup
• Actively participate in the initial 30-60 day build phase, which is critical to establishing a properly functioning marketing system
• Review and approve creative assets, copy, and campaigns within agreed timelines
• Maintain adequate advertising spend on the platforms we manage
• Communicate changes in business direction, service area, or offerings promptly

5. SMS Messaging Program

By submitting your phone number through any form on our website, you expressly consent to receive SMS text messages from Pool Bros Marketing (operated by Rocket Digital Marketing LLC) as part of our client communication and follow-up program.

• Program description: Our SMS program is used to follow up on inquiries, schedule strategy calls, share updates about your marketing campaigns, and communicate time-sensitive account information.
• Message frequency: Message frequency varies. You may receive messages in response to your inquiry or on an ongoing basis as part of an active client relationship.
• Rates: Message and data rates may apply. Please check with your mobile carrier for details.
• Opt-out: You may opt out of SMS messages at any time by replying STOP to any message. You will receive a confirmation message and no further SMS messages will be sent. To re-subscribe, reply START or contact us directly.

• Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.

6. No Results Guarantee

We do not guarantee specific lead volumes, revenue outcomes, search rankings, or advertising performance results. Digital marketing outcomes are influenced by numerous factors outside our control, including market conditions, competition, ad platform algorithm changes, and client participation. We commit to building your marketing system properly, staying engaged throughout the process, and applying best practices to maximize your results.

7. Intellectual Property

Upon full payment of all fees owed, clients own the following assets created specifically for their account:

• Custom website design and code
• Original copy and content written specifically for the client
• Custom graphics and brand assets created for the client

Pool Bros Marketing retains ownership of proprietary processes, templates, workflows, AI configurations, and methodologies developed independently of any specific client engagement. We reserve the right to reference completed work in our portfolio unless the client requests otherwise in writing.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive business information shared during the course of the engagement. This includes client business data, strategies, and financial information shared with Pool Bros Marketing, as well as our proprietary processes and pricing shared with clients.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Rocket Digital Marketing LLC and Pool Bros Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue, arising from your use of our services or website. Our total liability for any claim related to our services shall not exceed the total fees paid by you in the three months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Rocket Digital Marketing LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your use of our services.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, Florida.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised date. Continued use of our services after changes constitutes acceptance of the updated Terms.
